Every movement carries compliance exposure.
Under Section 34 of the Environmental Protection Act 1990, waste producers must ensure waste is transferred correctly: to a registered carrier, with accurate documentation, to a permitted destination.
Most of the evidence that proves you met that duty is scattered across emails, PDFs, tickets and subcontractors, pulled together, if at all, only after something has already gone wrong. You do not need to wait for that call to find out whether your evidence holds up.

The evidence trail runs back to the producer.
Enforcement is intelligence-led: financial data, permit records, whistleblowing, satellite and drone surveillance, ANPR and vehicle tracking can all feed into an investigation. It can start at a haulier, broker, or illegal site, then follow the evidence back through the chain.
Recent example
An arrest followed an investigation into a site near Camborne holding around 50,000 tonnes of construction waste.
Police, Cornwall Council and the Environment Agency were involved. Trust in the supply chain is not a defence. Evidence is.
The clock is running
Digital Waste Tracking lands on 1 October 2026.
This is weeks away, not years. The first phase applies to licensed or permitted waste-receiving sites in England and Wales from 1 October; Northern Ireland follows in January 2027.

What changes
Waste receivers must report structured records of every load received. The service is due to expand to carriers, brokers and dealers from October 2027.
Businesses still relying on fragmented paperwork, manual checks and after-the-fact evidence collection will be exposed as digital records become easier to compare. Those building a structured, auditable record now will simply carry on.
